Resumo
Este estudo aborda os principais desafios relacionados à aplicação da Lei Maria da Penha (Lei nº 11.340/2006) em comunidades indígenas no Brasil. A partir de uma pesquisa bibliográfica e documental, o estudo analisa como fatores culturais, sociais e estruturais interferem na efetivação da norma. Os resultados evidenciam que, mesmo com os avanços legais, as mulheres indígenas seguem expostas a múltiplas formas de violência, pela dificuldade de acesso aos serviços de proteção e desconhecimento da legislação. Soma-se a isso o conflito entre os sistemas jurídicos estatais e os costumes tradicionais, o que dificulta a aplicação da lei nas aldeias. Conclui-se que o enfrentamento da violência contra mulheres indígenas exige um esforço articulado que considere a diversidade cultural e promova estratégias intersetoriais, educativas e inclusivas, a fim de garantir proteção efetiva e respeito aos direitos humanos dessas populações.

Abstract
This study examines the main challenges in implementing the Maria da Penha Law (Law No. 11.340/2006) within Indigenous communities in Brazil. Based on bibliographic and documentary research, the study explores how cultural, social, and structural factors influence the effectiveness of the law. The findings reveal that, despite legal progress, Indigenous women remain vulnerable to various forms of violence, limited access to protective services, and lack of legal awareness. In addition, the conflict between the state legal system and traditional customs makes it difficult to apply the law in Indigenous territories. The study concludes that addressing violence against Indigenous women requires coordinated efforts that acknowledge cultural diversity and promote intersectoral, educational, and inclusive strategies to ensure effective protection and the upholding of human rights for these communities.
