Resumo

Se o Código Civil não conceituou o sossego e nem criou limites objetivos ao resguardo da paz social na vida comum, o ordenamento jurídico brasileiro dispõe de outras normas que, interpretadas e aplicadas de maneira sistêmica, permitem suprir essa carência, oferecendo um ambiente saudável. O objetivo do presente estudo é, portanto, promover uma análise sistêmica do ordenamento jurídico brasileiro, abordando os diferentes regramentos disponíveis e que permitem à sociedade o resguardo mínimo da ordem social, garantindo ao indivíduo, ainda que inserido no contexto das relações intersociais, conforto e segurança individuais.

Abstract

If the Civil Code did not conceptualize peace and did not create objective limits to the protection of social peace in common life, the Brazilian legal system has other norms that, interpreted and applied in a systemic way, make it possible to overcome this lack, offering a healthy environment. The objective of this study is, therefore, to promote a systemic analysis of the Brazilian legal system, addressing the different regulations available that allow society to maintain the minimum protection of the social order, guaranteeing the individual, even if inserted in the context of intersocial relations, comfort and individual security.
