Resumo
O presente estudo examina em que medida a eficácia horizontal dos direitos fundamentais tem sido aplicada nas decisões recentes do Tribunal de Justiça de Mato Grosso, Brasil. Para tanto, apresenta os conceitos de eficácia dos direitos fundamentais, diferenciando suas dimensões vertical e horizontal, além de abordar as principais teorias doutrinárias sobre a eficácia horizontal. Na sequência, analisa julgados recentes do referido tribunal, com o objetivo de identificar decisões que reconheçam expressamente a aplicação direta e imediata dos direitos fundamentais nas relações entre particulares, servindo como base para a fundamentação das decisões. A metodologia adotada é de natureza analítico-interpretativa, combinando pesquisa bibliográfica com análise de jurisprudência.

Abstract
This study examines the extent to which the horizontal effectiveness of fundamental rights has been applied by the Court of Justice of Mato Grosso, Brazil, in recent decisions. It outlines the concept of the effectiveness of fundamental rights, distinguishing between its vertical and horizontal dimensions. Furthermore, it discusses the main doctrinal approaches to horizontal effectiveness. The study then analyzes recent rulings from the aforementioned court with the aim of identifying decisions that expressly recognize the direct and immediate application of fundamental rights within private legal relations, thereby serving as a basis for judicial reasoning. The research methodology adopted is analytical-interpretative in nature, combining comprehensive bibliographic research with systematic case law analysis.
